Demolition in Talisay rescheduled due to rains

CEBU, Philippines - Because of the weather conditions yesterday, court sheriff Constancio Alimurung moved the demolition of houses and other structures in the property owned by lawyer Raul Sesbreño.

Alimurung said he will reschedule the demolition for today if the weather is good.

There are 43 houses in Lot No. 3255-A and Lot 1 located in Barangay Lawaan III in Talisay City scheduled for demotion.

However, he said Judge Gilbert Moises of Regional Trial Court Branch 18 deferred the demolition of eight out of the 43 houses pending the motion to defer demolition.

He said Moises is set to hear their motion on February 10.

Alimurung was the sheriff assigned to implement the writ of demolition issued by court clerk Grace Fernandez of RTC Branch 18.

“You are commanded to dispossess the defendants, their agents, assigns or anyone acting in their behalf including occupants and trespassers and demolish all their structures over Lot No. 3255-A and Lot 1 located at Lawaan III and Talisay City respectively and deliver the possession to plaintiff after which, return this writ with your proceedings endorsed in accordance with Section 14 of Rule 39 of the Rules of Court as amended,” the writ read.

Moises affirmed the decision of Judge Douglas Marigomen of RTC Branch 5 that Sesbreño was the legal owner of the lot.

Moises then ruled for the issuance of the demolition order and directed the issuance of writs of demolition of structures of the defendants including the occupants and trespassers. (FREEMAN)
