Brgy Luz demolition pushed back to May
CEBU, Philippines - For the second time, Judge Ramon Daomilas of Regional Trial Court Branch 11 pushed back the scheduled demolition of 36 houses in three sitios in Barangay Luz.
Daomilas directed Sheriff Jessie Belarmino to hold off the implementation of the writ of demolition of the structures and other improvements made in the lots occupied by the families until May.
Daomilas likewise ordered the defendants of the case to file their comment on the motion to stay execution and demolition with prayer for clarificatory judgment filed by the plaintiffs not later than this coming January 23.
The defendants of the case were Sitio Nangka Homeowners Association Inc., Sitio Mabuhay Homeowners Association Inc., Sitio Lubi Homeowners Association and the Province of Cebu.
Daomilas said in resetting the scheduled demolition to May 15, 2012, he sought to give the city government more time to relocate the affected families in Sitio Tac-an, Barangay Talamban, Cebu City.
Earlier, Daomilas moved the demolition, which was originally scheduled for December 8, 2011 to January 5, 2012, in the spirit of compassion.
Sitios Nangka, Mabuhay and Lubi were once part of the lots covered by Provincial Ordinance 93-1 but were turned over to Cebu City through a deed of assignment issued during the time of former governor Emilio Osmeña.
The affected fami-lies filed a civil case for injunction and preliminary mandatory injunction against their homeowners association seeking the partial annulment of the contracts and certificates of title.
These families refused to be part of the association and the Community Mortgage Program availed by their organization as they wanted to pay directly to the city government instead of paying to the association. – (FREEMAN)
