FLI wants P1.2B bondfrom Rallos lot heirs

CEBU, Philippines - Filinvest Land Inc. has filed a third-party claim before Sheriff Eugenio Fuentes to cover damages if a public auction of their lots at the South Road Properties pushes through.

Fuentes said FLI asked the heirs of Fr. Vicente Rallos to post a sheriff indemnity bond of P1.2 billion.

He added the P1.2 billion was the expenses of FLI in the development of the 97,621 square meters they are developing at the SRP.

The Rallos heirs chose the lot contracted by FLI as covered by the auctioned as payment for the P13.3 million judgment debt for the compensation of its property used as a public road by the city government. 

Fuentes said if the Ralloses cannot post P1.2 billion either in cash bond or surety bond on or before December 13, the public auction will not push through. Mauricio Rallos, one of the heirs, did not comment about the P1.2 billion but said his lawyer will meet to tackle the issue.

FLI said in an earlier statement that they will take all legal action to get back from the Ralloses whatever damages their press release and actions will cause FLI and its projects.

City lawyers also assured they will take all legal remedies if the lot contracted by FLI will be auctioned on December 13.

Meanwhile, Judge James Stewart Himalaloan of Regional Trial Court Branch 9 inhibited from further deciding on the Rallos case.

In yesterday’s hearing for the “motion to set case for hearing by the pairing judge”, Himalaloan said the motion for reconsideration filed by the city government will be heard if Executive Judge Silvestre Maamo has ruled on his inhibition.

Himalaloan instead directed the city government and the Rallos heirs to file their respective comments on his inhibition before Maamo on or before Monday.

Earlier, Himalaloan issued an omnibus order stating his inhibition in further hearing and deciding the cases of indirect contempt filed by the Ralloses and the urgent omnibus motion and supplemental urgent omnibus motion to quash the writ of execution and set aside the notice of garnishment.  (FREEMAN)
