For selling nubain Nurse faces charges
CEBU, Philippines - The Talisay City Prosecutor’s Office recommended no bail against the registered nurse who was arrested for allegedly selling Nubain.
Prosecutor Benjo Luther Macion recommended the filing of charges against Leonarda Lim of Lower Pakigne, Minglanilla for violating Section 5, Article II of Republic Act 9165 or the Comprehensive Dangerous Drugs Act.
Macion said because of the decision of the accused not to undergo preliminary investigation to answer the allegations filed against her, he found probable cause to elevate the same to the court.
The accused was arrested on October 21, 2011 at about 7:20 p.m. at the parking lot of a mall in Tabunok, Talisay City.
In the affidavit executed by PO3 Roy Carlo Veloso, who was designated as poseur-buyer, he stated that an informant went to their office at the Cebu Provincial Police Office (CPPO) and reported that Lim was engaged in selling nalbuphine hydrochloride, a dangerous drug, commonly known as Nubain.
Veloso said that to confirm the information they received, they made a transaction with the accused. Communicating through mobile phone, they arranged for a meeting at the parking lot of a mall in Tabunok, Talisay City at 7:30 in the evening of October 21, 2011.
A buy-bust operation was conducted in coordination with the Philippine Drug Enforcement Agency (PDEA).
At around 7:10 p.m., Veloso received a call from the accused that she was at the parking area standing at the driveway, prompting them to approach her.
Veloso said the accused immediately recognized them and asked how much they would want to buy. He replied many.
The accused offered to sell them at P100 each instead of P110, saying she was in a hurry.
Veloso opened three boxes of the dangerous drugs and examined these, then gave them back to the accused.
He gave the buy-bust money of P200,000 in exchange for one box.
When the accused received the cash, Veloso immediately introduced himself as police officer and arrested the accused.
Together with other officers who served as his back up, Veloso brought the accused to the Talisay City Police Station. — (FREEMAN)
