Due process assured in demolition of illegal structures in Naga, Toledo

CEBU, Philippines - The Department of Public Works and Highways (DPWH) assured yesterday that due process will be observed when illegal structures along national roads and highways will be demolished.

District Engineer James Dellosa of the DPWH Cebu 3rd District said those that will be affected are illegal structures along the Naga Uling Road in Naga City and Toledo Wharf Road in Toledo City.

He said the third and final notices have been distributed to the owners of the structures starting last Wednesday. He said a meeting with officials from the barangays and cities concerned will also be held prior to the actual demolition.

The move is in compliance with the directive of DPWH Secretary Rogelio Singson to clear national roads of obstructions that pose traffic accidental risks, conforming to section 23 of Presidential Decree No. 17. The decree provides that it will be unlawful for any person to usurp any portion of road-right-of-way, to convert any part of any public highway, bridge, wharf or trail to his own private use or to obstruct the same in any manner.

Meanwhile, Department of Interior and Local Government Secretary Jesse Robredo also issued Memorandum Circular 68 dated July 26, 2010, which directed governors, city and municipal mayors to strictly enforce the required easement of three meters on both sides on national roads and protection of the road-right-of-way from intrusions and illegal structures.

Several fatal vehicular accidents in the area that claimed the lives of innocent civilians could have been avoided if the road-right-of-way is respected, the DPWH said. (FREEMAN)
