Cop who shot inmate's visitor cleared

CEBU, Philippines -The policeman who shot dead a visitor at the Danao Police last week was cleared of charges after investigation found that his actions were legitimate.

Investigator Lamberto Hibaya of the Provincial Investigation and Detective Management Branch said SPO4 Jose Salingua Jr. shot Domiciano Estocado, 21, in line with the performance of his duty.

Salingua shot Estocado when the latter wrestled and tried to grab the service firearm of another policeman, SPO3 Aresteo Espina, who was frisking Estocado at that time.

Estocado, a former security guard, was visiting his young brother Jenny who was detained at the police station after he surrendered last March 7 in relation to a murder case that happened in Bacolod City.

Espina was the desk officer and jailer when the incident happened.

Salingua shot Estocado on the right thigh, but the latter pulled out a kitchen knife from his waist and attacked Salingua. This prompted Salingua to fire another shot and hit Estocado on the body.

Estocado was rushed to the Danao City District Hospital but he was declared dead on arrival.

Hibaya said they found no irregularities in the handling of evidence or any contrary accusations which can be construed that the killing was committed way beyond the lawful performance of the two policemen involved.

The investigation also found no compelling reasons to further restrict Salingua from returning to his post as radio operator. Hibaya said Salingua can already return to work once the Regional Police Office approves PIDMB investigation report.

Salingua who turned 52 years old just last March 2 already filed an application for an optional retirement with Camp Crame in Quezon City. — (FREEMAN)
