Murder case against Dumpit remains
MANILA, Philippines- Regional Trial Court Branch 6 judge Ester Veloso sustained her ruling to proceed with the murder case against SPO3 Adonis Dumpit.
Veloso yesterday denied Dumpit’s motion for reconsideration on the court’s refusal to admit the amended information downgrading the case to homicide for lack of factual and legal basis.
The court found Dumpit’s arguments moot and academic taking into consideration the reinstatement of the military ombudsman of their previous finding of probable cause for murder against the accused and the recall of the deputation of the Cebu City Prosecutor’s Office to prosecute the case.
Dumpit asked for a reconsideration of the February 22 order denying his motion to admit the amended information downgrading his case to homicide. He argued that he has the right to seek reconsideration because the denial has affected his rights, particularly to post bail for his temporary liberty.
The Office of the Ombudsman Visayas opposed Dumpit’s contention claiming that the arguments raised by the accused have already been ruled upon by the court.
For this reason, the court stated that there is no need for the issues raised by the defense to be discussed and therefore decided to deny the filed motion for reconsideration.
Veloso earlier denied the motion from the Office of the Ombudsman for the Military and Other Law Enforcement Offices that sought to admit amended information on the downgrading of murder to a homicide case.
The move for the downgrade of the case was done after a reinvestigation however Veloso said that the reinvestigation was not authorized and consented to by the court.
Further, Veloso also earlier approved Dumpit’s continued detention at the Criminal Investigation and Detection Group-7 headquarters for security reasons taking into account the statement of City Jail warden Efren Nemenio that he cannot promise 100 percent security for Dumpit.
Dumpit is accused in the killing of a suspected robber, Ronron Go, in December of 2004. — AJ de la Torre/BRP (FREEMAN NEWS)
