CEBU - The Department of Labor and Employment would like to reiterate that November 1 is a nationwide special holiday to all private and public establishments.
Pursuant to Memorandum Circular No. 1 of the Labor Code of the Philippines, it should be no work, no pay unless there is a favorable company policy, practice or collective bargaining agreement granting payment of wages on special days even if unworked.
If worked, the first eight hours shall have an additional 30 percent of the daily rate, and an additional 100 percent of the daily rate beyond eight hours of work.
Had it fallen on an employee’s rest day, an additional 30 percent of the employee’s hourly rate shall be granted while fifty percent of the daily rate shall be added to the salary if the employee works for the first eight hours.
Further, if the employee works beyond eight hours, he shall get 100 percent of the daily rate additional, plus 30 percent of hourly rate on the said day.
According to the DOLE, provisions shall apply to all private firms and public offices.
