In the 12-page decision handed down by SC First Division dated June 16, 2006 penned by Associate Justice Consuelo Santiago, the higher court dismissed the petition for indirect contempt filed by Douglas against Sarmiento and Makilito Mahinay, legal cousel of Nabua and her siblings.
Sarmiento favored Nabua by giving half of all Don Cayetano's properties in the civil case for accounting filed against her estranged son Douglas.
Aside from Nabua, the court also favored other siblings George Lu, Alex Lu, Cayetano Lu, Julieta Lu and Bernardita Lu.
Douglas, now the president of Lu Do and Lu Ym Corporation is holding "in trust" all of the properties of his late father.
The complainant siblings of Douglas said they are entitled to claim part of Don Cayetano's properties as heirs of the tycoon who died on April 14, 1983.
Alex, the brother of Douglas, earlier said that his brother has assets of the corporation valued at P15 billion, his father's house in Canada worth $350,000 to $450.000, his father's $120,000 account in the Bank of Scotia and a Mercedes Benz. - Ramil V. Ayuman/BRP
