Ernesto Labaro, 53, and Adonis Dianon, 40, failed to submit their counter-affidavit while the case was under preliminary investigation at the Talisay City Prosecutors' Office.
This prompted Talisay City prosecutor Marshall Rubia to file rape charges against the suspects before the court and recommended no bail for their temporary liberty.
The victim, a resident of Katipunan Street in barangay Labangon, works as a house help at her uncle's house in barangay Inayawan.
Based on the complaint, while the victim was waiting for a ride to visit her grandmother on April 4, the suspects allegedly approached her and forced her into a tricycle.
One of the accused reportedly poked a bladed weapon at the victim and threatened to stab her if she would shout for help.
The accused then allegedly brought her to Paz Beach Resort in barangay Cansojong, Talisay City where she was forced to drink beer and was slapped twice when she refused.
Moments later, Labaro allegedly raped the victim inside a cottage. Although it was only Labaro who reportedly raped the victim, Dianon refused to help the girl when she asked for his assistance.
Not satisfied, Labaro and Dianon allegedly threw the victim later into the sea but the girl managed to swim back to the shore. - Rene U. Borromeo
