DILG asked to sue Guadalupe chief

Acting Guadalupe barangay captain Ruben Baculi has asked the Department of Interior and Local Government to take legal action against suspended barangay captain Eugenio Faelnar for allegedly not serving his suspension.
Baculi, in a letter to the regional director of DILG, said that he assumed as acting barangay captain of Guadalupe last March 13 because of Faelnar's suspension by the Sandiganbayan last February 2.
Despite the suspension order and Baculi already taking over his office as mandated by the law on succession, Faelnar allegedly continues to function officially as the barangay captain, undermining the order of the court.
Baculi said Faelnar is intervening in the barangay council session by dictating the matters to be taken up and other matters pertaining to the duties of the barangay captain. In fact, Faelnar allegedly screens all official communications to the office not personal to him.
Faelnar is also leading the barangay activities and even obstructed to projects that he wants to implement.
"It is obvious that Mr. Eugenio E. Faelnar has never been suspended after all and the order remains without effect on him," Baculi said in a letter to DILG.
Baculi said the DILG should take the necessary legal actions to impose Faelnar's suspension and impose other sanctions applicable commensurate for undermining the lawful order of the court.
Faelnar and the other officials of the Association of Barangay Councils in Cebu City have been placed under a 90-day suspension because of the administrative complaint filed by dismissed ABC employee Leah Rondez, who complained of illegal termination and non-payment of her benefits. - Fred P.
