Brgy. San Nicolas Proper gets ok for standard fees

Finding them appropriate and reasonable, the city's committee on laws has recommended for the council to approve the proposals of barangay San Nicolas Proper, setting standard amounts for fees for barangay clearances and civil cases.

Barangay San Nicolas Proper submitted to the city council two resolutions with corresponding proposed ordinances. The first is barangay resolution No. 51 with corresponding ordinance No. 14 Series of 2005 entitled: "An ordinance imposing fees and other charges for the issuance of barangay clearance for residents who wish to secure barangay clearance."

The second is barangay resolution No. 50 Series of 2005 with corresponding ordinance No. 15 entitled," An ordinance imposing appropriate filing fee upon any complaint filed by any individual for any cause of action against another individual, be it oral or in writing to the Lupong Tagapamayapa through its chairman."

Proposed Ordinance No. 14 aims to set a standard fee for barangay residents who wish to secure barangay clearances for employment, school requirements, application for building permits for new construction, application for business permit with assessed capital, application for firearms registration and possession, marriage license, certification and related documents, personal certification, court clearance and police clearance and/or other clearances that require the barangay captain's certification.

In its report, he committee said that Resolution No. 51 with corresponding ordinance No. 14 is congruent to Article four, Section 152 of the Local Government Code of 1991 on the Scope of Taxing Powers wherein barangays may levy taxes, fees and charges.

The committee also finds resolution No. 51 within the limits set by law by specifically setting the limits on the payment schedule of civil cases involving the collection of money between P1,000 to P5,000 and the authority of the barangay captain to repeal or exempt payment. – Joeberth M. Ocao
