Public, private’s guide to 2023 revised JV guidelines

MANILA, Philippines — Joint Ventures (JVs) remain as the chosen and sought-after Public-Private Partnership (PPP) arrangement by government owned and controlled corporations. With the recently released National Economic Development Authority (NEDA)’s “Revised Guidelines and Procedures for Entering into JV Agreements between Government and Private Entities” that took effect on April 25, it is a must for businesses and GOCCs to know about these changes.

To guide those in the public and private sectors on these, the Center for Global Best Practices will host a pioneering MCLE-accredited training entitled Public and Private Entities’ Guide to NEDA’s 2023 Revised Joint Venture Guidelines and Procedures to be held on Tuesday, July 18 from 1:30 to 4:45 p.m. via Zoom.

Eliminate all confusions and risks when entering joint venture agreements. In this half-day webinar, attendees will be provided the right interpretations of the revised regulation which supersedes the 2013 version. Discussion will also cover modified requirements, approval requisites, and comparative matrix of the 2013 and 2023 guidelines of JV, 10 legal ways to shorten the process, best practices tips, valuable insights, and many more!

Learn all these from the Father of Philippine PPPs, lawyer Alberto Agra who is a Certified PPP Specialist™ and Certified Regulation Specialist™, a law professor, a Law-for-All advocate, an author, a sports servant-leader, and a masters obstacle sports athlete and throws pentathlete. Since 2014, he has conducted more than 376 lectures on PPPs. He has developed 35 PPP frameworks including a template PPP ordinance, which to date, has been referred to by 116 provinces, cities and municipalities. Furthermore, he is the incumbent chairman of the board of the Philippine Reclamation Authority, the infrastructure development authority focused on reclamation.

Registration is open to the general public. Key takeaways from this program are applicable both for private companies who want to do business with the government and for those in the public sector covered by these guidelines such as GOCCs, financial institutions, local water districts, etc. Lawyers are also encouraged to join this training to gain MCLE credit units.

CGBP is also an accredited training provider of the Civil Service Commission; DILG-Local Government Academy; Governance Commission for GOCCs; and other regulatory agencies. Government funds to be used in this training program will not be covered by Philippine Procurement Law or RA 9184 based on its Revised IRR’s Section 4.5-b, which classifies training and seminars as non-procurement activities. DBM circular 563 issued on April 22, 2016, also exempts public officials and government employees from the P2,000-limit per day on training fee.
