SC pinagmulta ng P30k si Badoy matapos mga banta, red-tagging vs hukom
MANILA, Philippines — Hinatulang "guilty" ng Korte Suprema ang dating tagapagsalita ng National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) sa salang indirect contempt matapos pagbantaan at iugnay sa mga rebeldeng komunista ang isang hukom sa Maynila.
Kaugnay ito ng reklamo laban kay Lorraine Badoy matapos ibasura ni Manila Regional Trial Court presiding judge Marlo Magdoza-Malagar ang isang petisyong naglalayong maideklarang iligal at terorista ang Communist Party of the Philippines at New People's Army (CPP-NPA).
"ACCORDINGLY, the Court finds Lorraine Marie T. Badoy-Partosa GUILTY of indirect contempt of court in accordance with Rule 71, Section 3(d) of the Rules of Court," ayon sa 52-pahinang desisyon ng Supreme Court na inilathala nitong Miyerkules.
"She is FINED the amount of PHP 30,000.000 and WARNED that a repetition of the same or similar acts in the future shall merit a more severe sanction."
Taong 2022 lang kasi nang sabihin ni Badoy sa isang burado nang Facebook post ang mga sumusunod na mga salita matapos tumanggi si Malagar sa petisyong ideklarang terorista ang CPP-NPA:
So if I kill this judge and I do so out of my political belief that all allies of the CPP NPA NDF must be killed because there is no difference in my mind between a member of the CPP NPA NDF and their friends, then please be lenient with me.
Dati pang sinasabi ng CPP-NPA at mga progresibong na hindi terorista ang dalawang pormasyon ngunit mga prinsipyadong "rebolusyonaryo."
Setyembre 2022 nang balaan ng Korte Suprema si Badoy na posible siyang ma-indirect contempt sa pagbibitiw ng naturang pahayag, lalo na't paghihikayat daw ito ng karahasan at peligro sa buhay ng mga hukom at kanilang pamilya.
Una nang dumepensa si Badoy sa kanyang mga salita at sinabing hindi ito pagbabanta, ngunit "hypothetical" lamang na argumento habang ipinapahayag ang kanyang disgusto.
'Tuwirang banta'
Sa kabila ng mga palusot ni Badoy, napagdesisyunan ng SC na "vitriolic statements and outright threats" ang mga katagang binitiwan ni Badoy.
Dagdag pa ng Korte, hindi na objective critism ang kanyang ginawa at sa halip ay mga direktang deklarasyong ang korte ay nagamit para "mapinsala ang publiko" habang isinulat aniya ang desisyon ng mga "pribadong mamamayang kunektado sa CPP-NPA-National Democratic Front of the Philippines."
"Ciitizens have a right to scrutinize and criticize the Judiciary, but it is their ethical and societal obligation not to cross the line," wika ng Korte.
"In this case, this Court wields its contempt power due to the harmful, vicious, and unnecessary manner in which respondent launched her criticism, evident in the immediate aftereffects her statements had on the public."
Hindi rin daw magagamit ang paalusot na "hypothetical syllogism" ang mga pahayag lalo na't hinayaan lang daw niya ang mga sumuporta sa kanya at hindi pinaalalahanan na hypothetical lang ang mga binitiwang salita. Patuloy lang din daw sa pagpapaskil ng statements si Badoy na "lalong nagpatindi ng apoy."
Desisyon ipinakita peligro ng red-tagging
Positibo namang sinalubong ng human rights groups ang desisyon ng Korte Suprema, lalo na't inilalapit daw nito sa publiko ang tunay na epekto ng red-tagging.
Lumabas din daw aniya sa imbestigasyon na lumabas ang ilang tagasuporta ni Badoy kung saan ipinagtatanong na ang address ni Malagar para "maisakatuparan" ang panawagan ng dating NTF-ELCAC spokesperson.
"The Supreme Court ruling brings to the fore the very real dangers posed by the terrorist- and red-tagging being done by Badoy-Partosa, the National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) and their ilk," sabi ng Karapatan ngayong Huwebes.
"At the minimum, victims of red- and terrorist-tagging suffer mental and psychological torture. Some are forced to relocate to avoid further persecution, as red- and terrorist-tagging is often accompanied by more serious forms of harassment and has led to the illegal arrest and detention, enforced disappearance or even the extrajudicial killing of victims."
Dagdag pa ng grupo, pinatotohanan lang nito ang ulat ni United Nations Special Rapporteur on the Situation of Human Rights Defenders Mary Lawlor na ang red-tagging ay isang uri ng "context-specific death threat in the Philippines."
Pinasalamatan din nila ang Movement Against Disinformation (MAD) sa pagtutulak ng kaso, habang ipinuputong tagumpay ito sa pagsisiwalat ng human rights violations ng NTF-ELCAC.
