Pagbabago ng IRR sa intensyon ng batas, ikinadismaya

MANILA, Philippines — Ikinalungkot ni Senador Francis “Tol” Tolentino ang pagbabago sa intensyon ng mga batas na pinagtibay ng Kongreso sa Implementing Rules and Regulation (IRR) na inisyu ng administrative agencies na naatasang gumawa nito.

Sa deliberasyon ng proposed Passive Income and Financial Intermediary Taxation Act (PIFITA) sa Senate Committee on Ways and Means nitong Lunes, tinanong ni Tolentino ang Bureau of Internal Revenue (BIR) kung maaari nitong ipatupad ang nabanggit na panukala nang walang IRR.

“A lot of our laws has been modified, reconfi­gured, mutated by IRR. There is only one lawmaking body— the Congress of the Philippines. Is the BIR ready to implement a law without IRR coming from your part?” ang tanong ni Sen. Tol.

Tiniyak ng mga opisyal ng BIR na maaari nitong ipatupad ang PIFITA nang walang IRR.

“If it is so stated by the legislative, then it can implemented,” tugon ni BIR representative Atty. Nelsie Arcolas.

Ang sentimyentong ito ni Sen. Tol ay mula sa mara­ming kaso kung saan ang IRR ng ilang batas tulad ng Milk Code ay lumihis sa layunin ng batas.

“It would be clear that the intent of the Congress is to have an air tight law and have it implemented without delegating it into an adminis­trative agency similar to BIR the power to modify and to enact regulations which would sometimes would be contrary to law,” ang pahayag ng senador.

Idinagdag niya na upang mapagtanto na ang layunin ng IRR na lumihis sa mga pinagtibay na batas, ipinasa ng Senado ang Anti-Agricultural Economic Sabotage Act bilang self-executory.
