Supreme Court sinibak 3 empleyado ng korte dahil sa pagtira ng shabu
MANILA, Philippines — Tanggal sa trabaho ang tatlong empleyado ng Court of Appeals (CA) dahil sa paggamit ng iligal na shabu o methamphetamine hydrochloride.
Ito ang ibinabang desisyon ng Korte Suprema en banc kaugnay ng reklamo kina Garry Caliwan, Edmundo Malit at Frederick Mauricio (Mauricio).
"The Supreme Court has imposed the penalty of dismissal from the service against three employees of the Court of Appeals (CA) for the use of the illegal drug methamphetamine hydrochloride, also known as shabu," sabi ng SC sa isang pahayag nitong Lunes.
"In 2022, Caliwan, Malit, and Mauricio tested positive for shabu, in a random drug test conducted by the CA. The result of the random drug test was confirmed by Labtox Analytical Laboratory, Inc., an accredited laboratory facility by the Department of Health-Dangerous Drugs Board."
Dahil sa early retirement ni Mauricio, inirekomenda ng Judicial Integrity Board (JIB) na maparusahan siya ng pagbawi ng kanyang retirement benefits, maliban sa accrued leave credits, at habambuhay na diskwalipikasyon sa public office kaugnay ng dismissal from service.
Una nang iklinaro ng Supreme Court na ang paggamit ng iligal na droga ay nangangahulugan din ng possession at/o paggamit ng illegal drugs o substances, at hindi lang basta grave misconduct, nang gawin ito ng mga miyembro ng hudikatura sa ilalim ng Rule 140 ng Rules of Court.
"[T]he Court found that the administrative liabilities of Caliwan, Malit, and Mauricio for the Use of Illegal Drugs or Substances have been sufficiently proven not only by the positive results of the random drug test held in 2022, but also by their own admissions," sabi pa ng korte.
"The Court thus agreed with the JIB that the penalty of dismissal from the service is proper and commensurate with the gravity of the offense that respondents committed considering that this is the second time that they have tested positive for dangerous drugs in a random drug test, and they did so after having been given a chance by the CA to undergo treatment and rehabilitation."
Pinaalalahanan naman ng Korte Suprema ang lahat ng court personnel na laging umakto nang naayon para mapanatili ang tiwala ng publiko sa hudikatura.
Taong 2023 pa nang ilabas ng korte ang "Guidelines for the Implementation of a Drug-Free Policy in the Philippine Judiciary" sa pagkilalang nakaaapekto ang paggamit ng droga sa dangal, dignidad at integridad ng mga opisyales at empleyado ng sangay ng gobyerno.
Inilabas ng SC ang naturang pahayag matapos ang sagutan nina Pangulong Ferdinand Marcos Jr. at dating Pangulong Rodrigo Duterte kung sino sa kanila ang "bangag" at "adik." — may mga ulat mula kay Ian Laqui
