SC hinimok ideklarang unconstitutional P125-M transfer sa OVP confidential funds
MANILA, Philippines — Naghain ng petisyon sa Korte Suprema ang isang grupo ng mga abogado, atbp. para ideklarang labag sa Saligang Batas ang paglipat ng P125 milyong confidential funds para sa Office of the Vice President.
Sa 49-pahinang petisyong isinumite ngayong Martes, inilalaban ngayon ng naturang grupo na maibalik ng OVP ang kontrobersyal na halaga sa Treasury.
"WHEREFORE, premises considered, it is most respectfully prayed that this Honorable Court declare the transfer of the amount of Php 125 million to the Office of the Vice PResident as UNCONSTITUTIONAL and that the [OVP] be ordered to return the money to the government's treasury," sabi ng petisyon.
"Other reliefs that are just and equitable under the premises are likewise prayed for."

Kabilang sa mga petitioner ang dating tagapagsalita ni Bise Presidente Leni Robredo na si Barry Gutierrez, dating commissioner ng Comelec na si Augusto Lagman, 1987 Constitution framer na si Christian Monsod, dating Department of Finance Undersecretary Cielo Magno atbp.
Matatandaang sinabi na noon ni Albay Rep. Edcel Lagman na labag sa konstitusyon ang paglilipat ng pondo mula sa Office of the President patungo sa OVP batay sa Section 25(5) of Article 6 ng Saligang Batas.
Aniya, ang transfer para sa augmentation ay kinakailangang manggaling sa savings ng opisinang tinutukoy. Lumalabas na P50 milyon lang ang savings ng OP ngunit P125 milyon ang nakarating sa OVP.
Napupunta ang naturang P125 milyong confidential funds, na hindi pa nadedetalye kung saan ginastos, lalo na't kinumpirma ng Commission on Audit na naubos ito sa loob ng 11 araw noong 2022. Gayunpaman, umabot naman daw ito ng 19 araw, sabi ng OVP.
Kabilang sa mga respondents ng reklamo sina Bise Presidente Sara Duterte, Executive Secretary Lucas Bersamin, at Budget Secretary Amenah Pangandaman.
Oktubre lang nang magdesisyon ang isang komite sa Kamara na gawing "zero" ang confidential funds ng OVP, Department of Education, atbp. sangay ng gobyerno para sa 2024 at sa halip ilipat na lang ito sa mga nagtitiyak ng seguridad sa West Philippine Sea.
