'Tuloy ang kaso': Sandiganbayan sinopla mosyon ni Herbert Bautista vs P57.4-M graft case

MANILA, Philippines — Hinarangan ng Sandiganbayan ang mosyon ni dating Quezon City mayor Herbert Bautista na tuluyang ibasura ang reklamong graft laban sa kanya kaugnay ng P32.2 milyong kontrata para sa pagkuha ng online occupational permitting at tracking system noong 2019.

Ayon sa 15-pahinang resolusyong pinetsahang ika-26 ng Abril, na kamakailan lang isinapubiko, sinabi ng Seventh Division ng antigraft court na "denied" ang omnibus motion ni Bistek na humihinging i-dismiss ang kaso.

"If read through only within the confines of the Information, it is at once clear that the issues raised by the accused cannot be considered in evaluating the sufficiency of the Information because the same largely pertain to extrinsic matters or evidence aliunde," ayon sa resolusyon.

"They not only highlight factual allegations that require evidence presentation but more so, relegate legal issues that require a conclusion from the court when trial is yet to begin. As such, the references raised by accused Bautista will be better ventilated during trial on the merits."

Una nang sinabi ni Bautista na wala siyang paglabag lalo na't nagsagawa naman daw ng public bidding at kumilos lang daw siya sa "good faith" ng mga nakababababa sa kanya na siyang responsable sa paghahanda ng bidding documents, pagbili ng supplies at negosasyon.

Iprinesenta rin ng comedian-turned-politician ang ilang dokumento kasama na ang mga sumusunod na ordinansa na siyang sumusuporta raw sa pagpapatupad ng proyekto: Ordinance No. 2827, s. 2019, Ordinance No. 2771, s. 2018 at Ordinance No. 2827, s. 2019.

Sinasabi ring walang personal na ganansya si Bistek mula sa proyekto lalo na't para raw ito sa ikapapakinabang ng kanyang mga nasasakupan.

"Absent any vexatious, capricious or oppressive delays, and without any unjustified postponements of proceedings during preliminary investigation, it is unwarranted to conclude that the accused’s constitutional right to speedy disposition of cases was infringed," sabi ng Sandiganbayan.

"WHEREFORE, the Urgent Omnibus Motion [To: (A) Quash the Information: and (B) Dismiss the Case With Prejudice] dated March 24, 2023 filed by accused Herbert Constantine Maclang Bautista is DENIED."

Ang dalawang counts ng diumano'y paglabag sa Section 3 (e) ng Republic Act 3019 ng Anti-Graft and Corrupt Practices Act ay nagbabawal sa mga public officials na magbigay ng "unwarranted benefit, advantage" o "preference" sa kaninuman gamit ang ang kanilang posisyon na siyang magreresulta sa kapinsalaan ninuman pati ng gobyerno.

Nilagdaan nina Associate Justice Ma. Theresa Dolores Gomez-Estoesta ang resolusyon, Associate Justice Zaldy Trespeses at Georgina Hidalgo.

Magpapatuloy ang arraignment at pre-trial ng inaakusahang artista sa ika-18 ng Mayo, 2023 sa harap ng Fourth at Seven Division.
