MANILA, Philippines — Lagpas 30 saksak sa iba't ibang bahagi ng katawan ang inabot ng isang unyonista sa Bacolod City bago mamatay, pagpapakita ng inisyal na imbestigasyong inilabas ng grupo niyang BPO Industry Employees' Network (BIEN) Philippines.

Ika-25 lang ng Abril nang unang ibalita ng BIEN ang sinapit ng kanilang paralegal officer na si Alex Dolorosa, na siyang tatlong araw munang nawala bago matagpuan.

Kilalang nag-oorganisa ng unyon at asosasyon ng call center agents atbp. sa sektor ng business process outsourcing (BPO) ang grupo nina Dolorosa.

"BIEN's initial report from the ground says that Dolorosa sustained a total of 31 stab wounds (7 on the front torso, 7 on the back torso, 16 on the neck, and 1 on the face)," ayon sa kanilang pahayag, Biyernes.

"Weapons used are an icepick and a knife. A notable icepick stab wound pierced his heart, and bruises on his body are taken as signs of torture and other bruises as signs of struggle."

 

 

Nakikitang nangyari ang krimen sa pagitan ng 12:00 ng hatinggabi at 4 a.m. Nawawala rin daw ang cellphone, wallet at Rusi motorcycle ng biktima nang matagpuan.

Hinihingian pa ng Philstar.com ng pahayag ang Bacolod Police tungkol sa imbestigasyon nila sa insidente ngunit hindi pa tumutugon sa ngayon. Wala pa rin silang sagot sa kung ano ang posibleng motibo at kung may persons of interest na. Pero tingin ng BIEN, hindi ito simpleng krimen lang.

"It is not a petty crime and we cannot underestimate the motive of the attack knowing that Alex has been working as a paralegal and an organizer helping his colleagues and friends in the BPO industry," wika ni Mylene Cabalona, pambansang tagapangulo ng BIEN.

"Alex was rooted deeply among the workers fighting together to improve their working conditions not only in their company but also in the entire industry."

Ilang taon nang nakikipaglaban para sa karapatan ng BPO workers si Dolorosa at nanguna sa mga laban gaya ng mass filing ng complaints alabn sa forced overtime noong Mayo 2019, bukod pa pangangalap ng suporta sa call center community sa pagtindig sa kabila ng posibleng pagganti ng kumpanya.

Imbestigasyon ng DOJ

Una nang kinundena ng Department of Justice ang pagpatay kay Dolorosa at iniutos ang imbestigasyon patungkol dito.

Huwebes lang nang atasan nila ang Nationa Bureau of Investigation na simulang silipin ang pagkamatay ni Dolorosa habang nakikipag-ugnayan ang DOJ sa Bacolod City government at Philippine National Police sa pangangalap ng impormasyon.

Inilalapit din ngayon ng Kagawaran ng Katarungan ang Witness Protection Program sa lahat ng mga may impormasyon sa kaso upang maprotektahan sila basta't kwalipikadong tumestigo.

May kinalaman sa pag-uunyon?

Kinundena na rin ng Commission on Human Rights (CHR) ang sinapit ni Dolorosa, maliban sa pagkakasa ng sarili nilang imbestigasyon upang malaman ang totoong motibo sa karahasang kanyang kinaharap.

"CHR Region VI has deployed a Quick Response Operation to aid in the pursuit of truth, parallel to our call for local authorities to increase their efforts in bringing the perpetrators to justice and uncovering the motives behind this act of violence," wika ng komisyon kanina.

"We note that the local police is already exploring possible motives, including robbery and other reasons possibly driven by anger due to the inflicted injuries."

Sa kabila nito, tinitignan din ng komisyon ang posibilidad na may kinalaman ito sa kanyang union work. Kamakailan lang nang iulat ng Human Rights Watch na tumulong si Dolorosa sa pagpapanalo ng apat na labor cases ilang araw bago siya patayin, maliban sa nare-redtag din ang kanilang organisasyon.

Nananawagan naman ngayon ang CHR sa gobyernong gumawa ng mas malalakas na polisiya upang maipagtanggol ang mga manggagawa't unyoonista sa bansa sa diwa ng Article XIII, Section 3 of the 1987 Constitution na siyang nagbibigay ng "full protection to labor."

"The workers’ right to organize and union member’s safety and security are especially crucial in the BPO sector, which is one of the country’s fastest growing industries, employing around 1.44 million Filipinos," patuloy nila.

CHR is thus alarmed and compelled to act whenever there are cases of violence and death involving union leaders and workers as part of the country's vulnerable sectors," dagdag pa ng CHR.

"Any form of alleged attack on workers’ union officers and members must be sufficiently addressed before they lead to distrust and tension between workers, employers, and the government, and the further marginalization of a group responsible for much of the country’s economic growth and recovery."

"Once more, we underscore the importance of respecting and protecting the rights of all workers, including the right to form and join unions, free from any form of intimidation, harassment or violence."
