'Kulang ebidensya': Reklamong cyberlibel ni Pacquiao vs Quiboloy ibinasura
MANILA, Philippines — Ibinasura ng Makati City Prosecutor’s Office ang reklamong cyberlibel ni 2022 presidential candidate Sen. Manny Pacquiao laban kay Kingdom of Jesus Christ founder Pastor Apollo Quiboloy matapos akusahan ng huli ang una kaugnay ng "maanomalyang" paggastos sa kaban ng bayan.
Setyembre 2021 nang ireklamo ni Pacquiao si Quiboloy — na wanted sa Amerika para sa sex trafficking ng mga bata — dahil sa ilang social media posts kung saan sinabing P3.5 bilyon ang inilaan ng senador sa pagpapatayo ng Sarangani Sports Training Center — bagay na hindi pa rin tapos. Sarangani lawmaker si Pacman mula 2010 hanggang 2016.
"WHEREFORE, premises considered, the complaint for Libel in relation to R.A. 10175 (otherwise known as the CYBERCRIME PREVENTION ACT of 2012) against APOLLO C. QUIBOLOY is repectfully recommended to be DISMISSED for insufficiency of evidence," ayon sa 8-pahingang resolusyon.
"Not all the elements [in Article 335 of the Revised Penal Code] concur in this case. Specifically, the element of actual malice is missing."
Una nang sinabi ni Pacquiao na ang P3.5 bilyon na tinutukoy ay inilaan talaga para sa Philippines Sports Training Center sa Bataan, at wala raw siyang kinalaman sa pagpapatayo noon.
Paliwanag ng Makati City Prosecutor’s Office sa resolusyon, bigo ang kampo ni Pacquiao na patunayang alam ni Quiboloy na mali-mali ang mga detalye sa likod ng kanyang mga paratang sa senador tungkol sa naturang proyekto.
"While it is possible that respondent could have known the truth about the existence of the three projects and their differences; and knowlingly intertwined and twisted the facts to show that corruption is present thereat; and that complainant is the one responsible for the same, it is equally possible that respondent only made those statements as what was told to him by his research team, not knowing fully well that three projects were actually involved," patuloy ng dokumento.
"Notably, the names of the projects and even the laws creating the same are somewhat similar."
Lunes lang nang tumanggi si Pacquiao na lumahok sa 2022 presidential debates na inihahanda ng SMNI, na nasa ilalim ni Quiboloy, habang sinasabing 'di niya masikmura ang kanyang mga "krimen." Isa rin sa mga dahilan niya ay ang kanyang reklamong libelo kay Quiboloy, na nagpapakilalang "appointed son of God."
