Piskal ng ICC may 'risonableng batayan' na maniwalang may crimes vs humanity sa 'drug war'

MANILA, Philippines — Nakakita raw ng risonableng batayan ang Internationalo Criminal Court (ICC) para paniwalaang nakagawa ng "crimes against humanity" sa pagsasagawa ng madugong gera kontra-droga ng administrasyon ni Pangulong Rodrigo Duterte.

Sa ulat na inilabas ng ICC, Martes, sinabing sinisilip nila ang mga "paglabag" gaya ng extrajudicial killings (EJK) na ginawa laban sa mga pinaghihinalaang nagtutulak at gumagamit ng droga mula pa noong ika-1 ng Hulyo 2016:

"The Office is satisfied that information available provides a reasonable basis to believe that the crimes against humanity of murder (article 7(1)(a)), torture (article 7(1)(f)) and the infliction of serious physical injury and mental harm as other inhumane Acts (article 7(1)(k)) were committed on the territory of the Philippines between at least 1 July 2016 and 16 March 2019, in connection to the WoD campaign launched throughout the country."

Sa opisyal na datos ng Philippine Drug Enforcement Agency (PDEA) na inlabas ng Realnumbersph nitong Nobyembre, umabot na sa 5,942 ang napapatay ng gobyerno sa anti-drug operations. Gayunpaman, iba pa riyan ang mga EJK — o mga pagpatay na ginagawa labas sa alituntunin ng batas.

Pebrero 2018 pa nang buksan ni ICC prosecutor Fatou Bensouda ang isang preliminary examination kaugnay niyan matapos aralin ang ilang communications at ulat na nagdodokumento sa diumano'y mga krimen.

Marso 2018 nang magpasa ng liham ang gobyerno ng Pilipinas sa United Nations Secretary-General António Guterres para bumaklas sa jurisdiction ng Rome Statute, ang tratadong lumikha sa ICC.

"In accordance with article 127, the withdrawal took effect on 17 March 2019. The Court retains jurisdiction over alleged crimes that have occurred on the territory of the Philippines during the period when it was a State Party to the Statute, namely from 1 November 2011 up to and including 16 March 2019," ayon pa sa ulat ng ICC.

"Furthermore, the exercise of the Court’s jurisdiction (i.e. the investigation and prosecution of crimes committed up to and including 16 March 2019) is not subject to any time limit."

Binuo ang ICC para imbestigahan, at kung minsan, litisin ang mga indibidwal na inaakusahan ng pinakamalalang crimes of concern sa international community gaya ng: "genocide," "war crimes," "crimes against humanity" at "crime of aggression."

Ayon pa sa ICC, libu-libo ra sa mga pagpatay ay ginawa ng mga hindi pa nakikilang mga salarin, na minsa'y tinatawag na "vigilante." Kadalsan ay nangyayari raw ito sa Metro Manila, Central Luzon, Central Visayas, Calabarzon atbp. lugar.

Nakatakdang pagdesisyunan ang paghiling sa authorization para pormal na buksan ang imbestigasyon sa sitwasyon ng Pilipinas sa "unang kalalahati ng 2021."

'Panahon ng pagtutuos paparating na kay Duterte'

Ikinatuwa naman ng ilang grupo ang panibagong development na ito, bagay na nagpipinta raw ng totoong imahe sa "polisiya ng pagpatay" ni Duterte.

"We welcome this significant development and its implications on what can only be described as a rapidly deteriorating human rights crisis in the Philippines," ayon sa Karapatan sa isang pahayag na inilabas ngayong araw.

"We look forward to the ICC-OTP’s conclusion of its preliminary examination and on the possibility of an investigation into the situation in the Philippines next year."

Aniya, Hunyo pa lang nang idetalye ng UN High Commissioner for Human Rights report at iba pang mga ulat ang pagkundena sa "anti-mamamayan" at madugong kampanya ni Digong, bagay na nagresulta raw sa malawakang pagpatay sa mahihirap, harassment at pagbira sa mga human rights defenders, mamamahayag at mga kritiko na minomonitor na rin daw ng ICC-OTP.

"The day of reckoning is coming nearer for Duterte’s reign of terror. As we await the decision of the Office of the Prosecutor, we press our calls for justice for the Duterte administration’s brutal crimes against the Filipino people," patuloy ng grupo.

Nananwawagan na rin sila sa ICC at iba pang human rights bodies gaya ng UN Human Rights Council na ituloy ang kanilang imbestigasyon sa lagay ng Pilipinas hanggang sa may mapanagot.

Ganito rin naman ang saloobin ng National Union of People's Lawyers (NUPL), habang inihahalintulad ito sa kaliwanagan ng pag-asa sa gitna ng kadiliman ng impunity.
