Dahil sa polyeto: Sedisyon vs. militanteng nag-relief operations, makatwiran ba?

MANILA, Philippines — Humaharap ngayon sa patong-patong na kaso ang ilang militante matapos tangkaing mamahagi ng relief goods sa gitna ng ipinatutupad na enhanced community quarantine (ECQ) sa buong Luzon kontra coronavirus disease (COVID-19).

Ika-19 ng Abril, Linggo nang umaga, nang harangin ng Philippine National Police sina dating Anakpawis Rep. Ariel Casilao at anim na volunteers ng Sagip Kanayunan at Tulong Anakpawis sa isang checkpoint sa Norzagaray, Bulacan.

Sinampahan sila ng kasong paglabag sa Article 142 ng Revised Penal Code o Inciting to Sedition, Republic Act 11332 o "Mandatory Reporting of Notifiable Diseases and Health Events of Public Health Concern Act" at Proclamation 922, na nagdedeklara ng public health emergency sa Pilipinas dahil sa COVID-19.

Humaharap din sa paglabag sa Article 177 ng RPC o Usurpation of Authority si Casilao. Dagdag pa ng Department of the Interiot and Local Government, iligal ang paglabas nila sa Metro Manila dahil sa "stay at home policy" ng gobyerno.

Ayon kay Local Government Undersecretary Jonathan Malaya, lumalabas na magsasagawa lang ng "propaganda kontra gobyerno" at ipinagbabawal na "mass gathering" ang grupo dahil sa sari-saring polyeto, tarpaulin at iba pang printed materials na nakita sa jeep kasama ng 50 food packs.

"Anakpawis will have their day in court. The DILG assures them of due process. Sa korte na sila magpaliwanag," ani Malaya.

Pero may ligal na bigat ba ang mga paratang?

Proclamation 992: 'Di pwedeng ikakulong

Hinihiling ngayon ng grupong Sentro Para sa Tunay na Repormang Agraryo (SENTRA), isang organisasyong nagbibigay ng libreng legal assistance sa mga magsasaka, mangingisda atbp., na agad palayain ng Office of the Prosecutor ng Bulacan ang pito.

Depensa ng SENTRA, ni hindi man lang daw batas ang isa sa mga isinampa sa kanila, habang hindi raw mapatutunayan sa korte na nilabag ang iba pang mga reklamo.

"[Presidential Proclamation] 992 and other presidential or government issuances or guidelines imposing the Enhanced Community Quarantine (ECQ) are not penal laws. They are not even laws," sabi ng grupo.

"They could not therefore serve as a basis for arresting anyone. The president has no power to criminalize acts even in times of emergency."

Kung titignang maigi ang Proclamation 922, walang pangungusap na nagsasabing maaaring mang-aresto dahil sa paglabag dito.

Hindi rin daw lulusot ang reklamo ng DILG na dapat harangin sa mga checkpoint ang mga aktibista lalo na't meron naman daw silang "food pass" na inisyu mismo ni Eduardo Gongona, na national director ng Bureau of Fisheries and Aquatic Resources (BFAR).

Aniya, bagama't nakapangalan ito kay dating Anakpawis Rep. Fernando Hicap ay valid daw ito hanggang ika-30 ng Hunyo. 

Imposible rin daw na lumabag si Casilao kaugnay ng usurpation of authority lalo na't hindi naman daw siya nagkunwaring kinatawan pa rin ng Anakpawis sa Kamara.

Dyaryo, magazine at sedisyon

Kwinestyon din ng SENTRA ang kasong inciting to sedition sa mga aktibista, bagay na nakita raw sa publikasyong "Linang," zine ng grupong Sama-samang Artista para sa Kilusang Agraryo (SAKA) at dyaryong Pinoy Weekly sa jeep.

Ayon sa batas, nangyayari ang sedisyon kapag nangyayari ang sumusunod:

"[A]ny person who, without taking any direct part in the crime of sedition, should incite others to the accomplishment of any of the acts which constitute sedition, by means of speeches, proclamations, writings, emblems, cartoons, banners, or other representations tending to the same end, or upon any person or persons who shall utter seditious words or speeches, write, publish, or circulate scurrilous libels against the Republic of the Philippines or any of the duly constituted authorities thereof, or which tend to disturb or obstruct any lawful officer in executing the functions of his office, or which tend to instigate others to cabal and meet together for unlawful purposes, or which suggest or incite people against the lawful authorities or to disturb the peace of the community, the safety and order of the Government, or who shall knowingly conceal such evil practices."

"[T]he arrested relief workers committed none of those instances," dagdag ng SENTRA.

Ayon sa Article III, Section 4. ng 1987 Constitution, may kalayaan ang sinuman na magpahayag ng anumang opinyon tungkol sa mga isyung panlipunan: 

"No law shall be passed abridging the freedom of speech, of expression, or of the press, or the right of the people peaceably to assemble and petition the government for redress of grievances."

Kinundena rin ng media outfit na Pinoy Weekly ang pagtawag ng National Task Force to End Local Communist Armed Conflict sa kanilang dyaryo ilang "anti-government pamphlet" para siraan diumano ang efforts ng gobyerno kontra COVID-19.

Depensa nila, ginagampan lang nila ang kanilang trabaho bilang mga journalist sa mga naturang sulatin.

"Has the Bulacan PNP, in effect, and by extension the police and the military, now become arbiters of news in the country?" sabi ni Kenneth Guda, punong patnugot ng Pinoy Weekly.

"We challenge them to fact-check every article on the old issues of Pinoy Weekly that they confiscated from the relief workers."

Ayon naman sa SAKA, na gumawa ng zine nasabat din sa jeep, hindi rin iligal ang nilalaman ng kanilang sulatin.

"We stand that our zine, COVID primer is not seditious. It does not call for overthrowing the government," ani Donna Miranda, spokesperson ng SAKA.

"Rather the primer orients people with what the COVID lockdown is all about."

Sabi pa niya, idinidetalye lang din sa nasabing zine kung paano mapipigilan ang pagkalat ng COVID-19 at paggigiit sa seguridad sa pagkain sa panahon ng pandemic.

bahagi lang din daw ang relief operation na nangyari sa pagpapaalala sa publiko na kulang ang tugon ni Pangulong Rodrigo Duterte sa pangangailangan ng mamamayan.

Mass assembly hindi nangyari

Pagtataka pa ng SENTRA, ginagamit daw na dahilan ng DILG, PNP at National Task Force to End Local Communist Armed Conflict ang mga nakitang materyales bilang patunay na magsasagawa sila ng "mass assembly," bagay na ipinagbabawal muna sa ngayon bilang pagtalima sa social distancing.

"[W]as there a crime committed if they intended to have a mass assembly when the mass assembly per se did not happen? Certainly there is none," sabi ng grupo.

Itinatanggi din nilang nagpumiglas sa pag-aresto ang mga suspek, lalo na't wala naman daw nag-resist sa kanila ni isa laban sa mga pulis.

Hindi rin daw maaaring panagutin sa RA 11332 ang mga nahuli lalo na't hindi naman nagdadala ng COVID-19 ang mga relief workers.

Una nang sinabi ni Malaya na ipinapahamak ng mga militante ang Norzagaray dahil sa kanilang ginagawa.

"By doing this obvious propaganda stunt, Anakpawis has placed the lives of the people of Bulacan at risk. Wala pong pinipili ang COVID-19... Mayaman man o mahirap," sabi ng DILG official. — may mga ulat mula kay Franco Luna
