Kaso ni Kris Aquino vs Nicko Falcis ibinasura

MANILA, Philippines — Dinismiss ng Makati City Prosecutor's Office ang kasong qualified theft na isinampa ng aktres na si Kris Aquino laban kay Nicko Falcis, dating project manager at managing director ng kumpanyang Kris Cojuanco Aquino Productions.

Inaprubahan ng Makati City prosecutor ang resolusyon ni Assistant City Prosecutor Paolo Barcelona.

Aniya, walang probable cause ang reklamo.

Oktubre 2018, pinaratangan ni Aquino si Falcis ng pag-charge ng halos P1 milyon mula sa isang BDO corporate card sa ilalim ng KCAP para sa pansariling gastos nang walang pahintulot. 

Dahil dito, naghain ang "Queen of All Media" ng reklamong theft laban sa kanya sa pitong lungsod: Quezon City, Mandaluyong, Pasig, San Juan, Taguig, Makati at Maynila.

"After careful examination of the records of the case, this Office is inclined to dismiss the complaints as there is no sufficient evidence to engender a well-founded belief that Falcis committed the crimes charged," ayon sa resolusyon.

Aniya, in-issue ang KCAP card sa pangalan ni Falcis kung kaya't maaari niya itong gamitin alinsunod sa terms and conditions ng BDO. 

Dahil dito, hindi siya maaaring kasuhan ng pagnanakaw kahit na ginamit niya ito sa sarili.

"In addition, no proof was presented that he used the card with intent to gain or intent to defraud. Accordingly, he is, at most, only liable to pay his credit card bill that has become due."

Dagdag ng desisyon, hindi mahalaga kung binayaran ni Aquino ang credit card ni Falcis. Ang tangi lang daw na magagawa ng aktres ay humingi ng reimbursement ng halagang kanyang binayaran.

Sa pagpapatuloy ng iringan ng dalawang kampo, kinasuhan rin ng cyberlibel ang kapatid ni Falcis na si Jesus noong Nobyembre 2018. — James Relativo
