David naghain ng motion for reconsideration sa desisyon ng SET kay Poe

MANILA, Philippines – Muling iginiit ng natalong senatorial candidate Rizalito David na hindi maaaring umupo sa puwesto si Sen. Grace Poe dahil sa kaniyang citizenship.

Naghain si David ng motion for reconsideration kasunod ng pagbasura ng Senate Electoral Tribunal's (SET) sa petisyon niya na diskwalipikahin si Poe.

Sa botong 5-4 ay nanaig ang mga botong nagsasabing tunay na Pilipino si Poe.

Mga kapwa senador ni Poe ang pumabor sa kaniya na sina Sens. Loren Legarda, Vicente "Tito" Sotto III, Cynthia Villar, Paolo Benigno "Bam" Aquino IV at Pia Cayetano.

Natalo naman ang botong madiskwalipika si Poe nina SET chair senior Associate Justice Antonio Carpio, Associate Justice Teresita Leonardo-De Castro, Associate Justice Arturo Brion at Sen. Nancy Binay.

Samantala,  naglabas naman ng 35-pahinang opinyon si Carpio kaugnay ng pagkapanalo ni Poe sa kaso.

 “The citizenship requirement under the Constitution to qualify as a member of the Senate must be complied with strictly. To rule otherwise amounts to a patent violation of the Constitution. Being sworn to uphold and defend the Constitution, the members of this tribunal have no other choice but to apply the clear letter and intent of the Constitution,” sabi ni Carpio.

Nauna nang sinabi ni Carpio na naturalized citizen lamang si Poe at hindi natural-born Filipino tulad ng kinakailagan pang makahawak ng pwesto sa so gobyerbo.

Bukod sa kaso sa SET ay hindi bababa sa tatlong kaso ang inihain sa Commission on Elections upang ipabasura ang certificate of candidacy niya.
