TRO vs Pantranco franchise sale ibinasura ng CA
MANILA, Philippines - Ibinasura ng Court of Appeals ang kahilingan ng tatlong malalaking Luzon bus operators na pag-iisyu ng temporary restraining order (TRO) sa desisyon ng Land Transportation and Franchising and Regulatory Board (LTFRB) na nagbigay daan sa pagbebenta ng bus franchise ng naluging Pantranco North Express, Inc. (PNEI).
Sa tatlong pahinang resolution na inilabas noong June 28, 2012, sinabi ng CA Eight Division na wala silang nakitang basehan para katigan ang kahilingan ng Philippine Rabbit Bus Lines Inc., Genesis Transport Service Inc., at Pangasinan Solid North Transit Inc. na “immediate issuance of a Temporary Restraining Order and/or Writ of Preliminary Injunction” laban sa LTFRB.
Gusto ng tatlong nabanggit na bus companies na ipawalang-bisa ng appellate court ang May 21, 2012 decision ng LTFRB na kumatig sa public auction ng Pantranco bus franchise para sa mga nadismis na empleyado nito bilang tugon sa kanilang labor claims, na nagresulta sa pagbebenta ng prangkisa sa mga kakumpetensya ng Rabbit, Genesis at Solid North.
“In the case at bar, there is no showing that the matter is of extreme urgency and that petitioners {Rabbit, Genesis, and Solid North] will suffer grave injustice or sustain injury beyond possibility of repair or beyond possible compensation in damages. Wherefore, petitioners’ application for the issuance of a Temporary Restraining Order and/or Writ of Preliminary Injunction is hereby denied,” pahayag ng appellate court.
Samantala, nagpasalamat naman ang mahigit 2,000 dating empleyado ng naluging Pantranco North Express, Inc., dating isa sa pinakamalaking bus company sa bansa, sa Court of Appeals sa mabilis nitong pagdedesisyon sa kaso.
