TRO sa Camp John Hay pinalawig ng 17 days

MANILA, Philippines - Pinalawig ng Baguio City court ang naunang inisyu nitong temporary restraining order laban sa planong take over ng Bases Conversion Deve­lopment Authority (BCDA) sa loob ng Camp John Hay.

Sa 2-pahinang desisyon ni Judge Mona Lisa Tiongson-Tabora ng Baguio City-RTC branch 7, pinalawig nito ng 17 araw ang TRO na unang ibinigay nito sa kahilingan ng Camp John Hay Development Corporation (CJHDevCo). Naunang nagpalabas ng 72-hour na TRO si Judge Iluminada Cabato.

Matapos ang gina­wang pagsusuri ng korte sa alegasyon ng petitioner, “the Court finds that great and possibly irreparable injury might be suffered by the petitioner if the 72-hour TRO, which expires (Friday), is not extended.”

“Wherefore, as prayed for by the petitioner, the 72-hour TRO issued by Executive Judge Iluminada P. Cabato on Ja­nuary 24, 2012 is hereby extended for seventeen (17) days starting . . . January 28, 2012,” utos pa ng judge.

Inatasan ng korte ang BCDA na huwag okupahin ang mga Camp John Golf Club, Manor Hotel, Camp John Hay Suites Hotel, CJHDevCo officers, gayundin ang mga jey facilites at utilitites sa loob ng John Hay.

“The respondent Ba­ses Conversion Development Authority, its subsidiaries, officials, employees, agents or any other person/entity acting for or in its behalf, are hereby ordered to restrain or desist from committing any act tending to wrest control and/or possession of the property subject of this case or any part thereof including all improvements found therein, from petitioner Camp John Hay Development Corporation and/or persons claiming rights to the leased property or portions thereof from said petitioner, including any act of forcible entry or forceful occupation and/or ejectment of said petitioner or its authorized representatives and/or any award of rights in the subject property to a new entity,” giit pa ni Judge Tabora.

Magugunita na nag­sampa ng reklamo sa korte ang CJHDevCo upang pigilan ang planong takeover ng BCDA sa kanilang opisina at iba pang establishments sa loob ng Camp John Hay.
