SC nag-isyu ng TRO sa reso ng Manila City Council sa port project

MANILA, Philippines –  Nagpalabas ng temporary restraining order ang Korte Suprema kaugnay sa resolusyong ipinasa ng City of Manila at sa City Council na pinangungunahan ni Vice Mayor Francisco “Isko” Moreno na nagpapahinto sa implementasyon­ ng Manila International Container Terminal (MICT) Berth 6 project ng Philippine Ports Authority­ (PPA).

Nakapaloob sa dalawang pahinang resolusyon ang paggagawad ng Second Division ng SC na pinamumunuan ni Senior Associate Justice Antonio T. Carpio ng TRO na inisyu noong Dec. 8, 2010 kaugnay sa inaprubahan ng City Council ng Manila na Resolution­ No. 141.

Hiniling ang naturang­ TRO kaugnay na rin sa na­­turang resolusyong ipi­­na­labas ng nasabing lung­­sod noong Sept. 23, 2010 na nagrerekomendang ihin­to at suspindehin ang isinasagawa ng MICT Berth 6 pro­ject na pinasok nang Phil­ippine Port Autho­rity sa International Container Terminal­ Services, Inc. (ICTSI) para sa ma­nagement, operation at development sa MICT hangga’t hindi na­isa­­sa­ayos ang mga ki­na­kailangang requirement sa ilalim ng Local Govern­ment Code and Manila Water Code. 

Ipinaliwanag ng ICTSI na walang awtoridad ang city council na mag-impose ng karagdagang requirements para sa port construction sa Port District ng Manila. Gayundin­, sa bagong Manila Water Code na inaprubahan ng konseho ng lungsod, hindi nito puwedeng amiyen­dahan ang PPA charter at ang laws and rules nito  sa reclamation of land hinggil sa port projects.

“Neither the Public Estates Authority nor the Phi­lippine Reclamation Authority, and much less, the City of Manila can va­lidly assert their respective legal authority over the project even if it entails land reclamation,” pahayag ni Senate President Juan Ponce Enrile.
