VAT sa toll fees hinarang sa Supreme Court
MANILA, Philippines - Hiniling kahapon ng isang dating mambabatas na pigilan ng Korte Suprema ang Bureau of Internal Revenue (BIR) at Toll Regulatory Board (TRB) sa pagpapatupad ng VAT sa toll fees simula sa Lunes.
Sa inihaing petition ni dating Nueva Ecija 1st District Rep. Renato Diaz at dating DTI assistant secretary Aurora Ma. Timbol, hinikayat nito ang Mataas na hukuman na mag-isyu ng status quo order laban sa BIR at TRB sa pagpapatupad ng VAT sa toll fees.
Sinabi ng petitioners na ang pagdagdag ng VAT sa toll fees ay paglabag sa konstitusyon at maituturing na “invasion of legislative powers”.
Si Diaz ang principal author sa House of Representatives ng Republic Act 8424 o ang Comprehensive Tax Reform Act of 1997 at RA 7716 o ang Expanded Value Added Tax law at nagsabing ang toll fees ay hindi kasama sa sale of services na kailangan lagyan ng VAT.
