Gica magpabiling mayor sa Dumanjug

CEBU, Philippines — Magpabiling mayor sa Lungsod sa Dumanjug si Efren Guntrano Gica human gi-deny sa Court of Appeals (CA) ang motion for recommendation (MR) nga gipasaka ni kanhi mayor Nelson Garcia tungod sa kakulang sa gibug-aton sa ebidensiya.

“Wherefore, premises considered, both motions for reconsideration are denied for lack of merit,” nakasulat sa CA resolution nga gipagawas niadtong Abril 10.

Niadtong Hulyo 2018, mipagawas og desisyon ang CA nga i-abswelto si Gica sa pasangil nga pagpangawat gikan sa kaban sa katawhan pinaagi sa pag-usab sa resibo alang sa usa ka liquidation report.

Wala makauyon sa unang desisyon, mao nga nisumitir og MR si Garcia. Basi sa dokumento, mipadayag kini nga dili mahimong maabswelto sa kaso si Gica pinaagi sa Aguinaldo Doctrine kay kini wala na giila sa batakang balaud sukad niadtong tuig 2015.

“With due respect, this honorable court erred in applying the Aguinaldo Doctrine to the case of petitioner Efren Guntrano Gica in disregard of the decision of the Supreme Court in the case of Carpio-Morales Vs Court of Appeals and Mayor Binay, GR no 217126-27, November 10, 2015,” matud sa suwat ni Garcia.

Ang Aguinaldo Doctrine nagpasabot nga napasaylo sa katawhan ang nabuhat nga bati sa usa ka opisyal kon kini midagan ug midaug og balik sa susamang posisyon ug lugar.

Gitubag ang MR ni Garcia sa CA karong bulana.

“It is indisputable that the test for determining whether or not the condonation doctrine can still be applied is the date of the institution of action and not the date when the official is re-elected,” suwat ni Assistant Justice Marilyn Lagura-Yap.

Ang gireklamo nga resibo adunay petsa nga Hulyo 15, 2014 samtang napili og balik isip mayor si Gica sa tuig 2016.

“The doctrine still applies to him. Thus, we see no persuasive reason to depart from our previous findings,” dugang sa CA. Nalipay si Gica sa kalambuan sa iyang kaso.

“I did not steal 10,000 pesos and I did not falsify the receipt. I won the case and I will win the cases filed against me coz it is all fabricated allegations. The Garcia's are masters in the art of MUGNA-MUGNA,” matud ni Gica sa Banat News pinaagi sa text message.

Misulat usab si Gica sa CA aron pagmando sa mga opisyales sa Department of Interior and Local Government (DILG) nga ipa-control ang ilang mga tawo aron dili na mag-implementar og desisyon nga nahuman na ang validity kon functus officio.

Ang CA midirekta sa DILG aron mosulat og bawos sa maong motion ni Gica.
