Kaso ni Radaza sa isyu sa lamppost gi-dismiss sa Sandiganbayan

CEBU, Philippines - Gi-dismiss sa Sandiganbayan Fifth Division ang kaso ni kaniadto Lapulapu City mayor ug karon Lapulapu Lone District Rep. Arturo Radaza kabahin sa lamppost controversy.

Ang maong kaso nga paglapas sa Akta Republika 3019 kon “Anti-Graft and Corrupt Practice Act” gibasura niadtong Enero 16, 2013.

Gawas kang Radaza gi-dismiss usab ang mga kaso batok nila ni Robert Lala, Gloria Dindin, Marlina Alvizo, Pureza Fernandez Agustinito Hermosa, Luis Galang, Restituto Diano, Buenaventura Pajo Julito Cuizon, Fernando Tagaan Jr., Rogelio Velasco ug Isabelo Braza.

Matud pa nga wala hatagi og patas nga imbestigasyon ang mga akusado gumikan sa wala pagpresentar sa nangawala nga pahina isip mga dugang dokumentong ebidensya nga giingong makapamatuod nga naalkanse ang gobiyerno sa pagkapalit sa maong mga lamppost.

Ang desisyon gipirmahan nila ni Associate Justice Napoleon Inoturan ug gi-concur nila ni Associate Justice Alexander Gesmundo ug Rolando Jurado, chairperson.

Ang Sandiganbayan mimando usab sa pagkanselar sa gikatakdang hearing sa maong kaso niadtong Enero 24, 2013 ug ang bond nga gibayad sa mga akusado gikanselar usab ug gipauli ngadto kanila sa mga akusado.

 Ang maong kaso ni Radaza ug sa mga kauban may kalambigitan kini  sa gipasangil nga gipaburot nga presyo sa lamppost niadtong tuig 2008 nga gigamit atol sa 12th ASEAN Summit nga gipahigayon nganhi sa Sugbo.

“After weighing the merits of the argument set forth by the parties, this Court finds the dismissal of the case is warranted,” matud pa sa desisyon.

“It is readily apparent that the accused were deprived of this opportunity. Notably, the accused repeatedly asked to be furnished the missing documents. The refusal of the Ombudsman to furnish them with the missing pages is highly irregular which prejudicial to the interest of the movants to effectively prepare their counter-affidavit. The accused should have given a copy of the missing documents,” matud pa sa Sandiganbayan.

Midugang ang Sandiganbayan nga premature ang pagsang-at sa kaso ug wala’y probable cause aron ipadayon ang kaso batok sa mga akusado. (BANAT NEWS)
